1. Who we are
thecilveras.com (the "Site") and the Cilveras brand are operated by Ecom Labz LLC, a limited liability company organized under the laws of Florida, with its business address at 834 Cordova Palms Pkwy, St. Augustine, FL 32095 ("Cilveras", "we", "us"). 2. Agreement to these terms
By visiting the Site or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy and Return & Refund Policy, which form part of them. If you do not agree, please do not use the Site. You must be at least 18 years old to place an order.
3. Our products
Our jewelry is made of 925 sterling silver (92.5% pure silver). Some designs carry rhodium or gold plating over sterling silver, as described on each product page. Pieces are cast and hand-finished in small batches, so minor variations in surface detail and finish are natural and are not defects. Colors may display differently on screens. Ring sizes follow the U.S. scale; the inner circumference in millimeters is given on each product page.
4. Prices and payment
All prices are in U.S. dollars. Applicable sales tax is calculated and shown at checkout. We accept the credit and debit cards and digital wallets displayed at checkout; payments are processed by secure third-party payment processors, and we do not see or store your full card number. If a product is listed at an incorrect price due to an error, we may cancel the order and will refund any amount paid.
5. Orders
An order confirmation email means we have received your order; our acceptance occurs when the order is dispatched. We may refuse or cancel an order for reasons including suspected fraud, failed payment verification or stock unavailability, and we will refund any payment made for a cancelled order. You are responsible for providing an accurate shipping address.
6. Shipping
We currently ship within the United States only, free of charge, from Cromwell, Connecticut, by USPS. Processing takes 3–5 business days and delivery 3–5 business days after dispatch. Full details are in our Shipping Policy. Risk of loss passes to you on delivery to the address you provided.
7. Returns and refunds
Unworn items in original condition may be returned within 30 days of delivery, as set out in our Return & Refund Policy. Personalized and engraved items are final sale unless damaged, defective or incorrect.
8. Lifetime Limited Warranty
We warrant to the original purchaser that our jewelry is free from defects in materials and workmanship under normal use, for as long as the original purchaser owns the piece. If a covered defect appears, we will repair or replace the item at our discretion; if neither is possible, we will refund the purchase price. The warranty does not cover normal wear, scratches, tarnish, gradual wear of plating, loss, theft, accidental damage, misuse, improper care, or damage caused by alteration, resizing or repair by anyone other than us. To make a claim, email info@thecilveras.com with your order number, a description and photos of the issue; we will reply within 1-3 business days with next steps and provide a prepaid return label for approved claims. This warranty is not transferable. It gives you specific legal rights, and you may also have other rights that vary from state to state.
9. Personalization
Engraving is available on request for selected designs. Please contact us before ordering to confirm the options for your chosen piece. You are responsible for the accuracy of the text you provide. Personalized items cannot be returned or exchanged unless they are damaged, defective or differ from the approved request.
10. Promotions
Promotional codes are valid only during the stated period, cannot be combined with other offers unless stated, and cannot be applied to past orders.
11. Intellectual property
All designs, product photographs, text, logos and other content on the Site are owned by or licensed to Ecom Labz LLC and are protected by applicable intellectual property laws. You may not copy, reproduce or use them without our written permission, except as needed to browse and shop on the Site.
12. Reviews and submissions
If you submit a review, photo or other content, you confirm that it is your own genuine opinion or work, and you grant us a non-exclusive, royalty-free license to display it in connection with our products. We may remove content that is false, offensive or infringes the rights of others.
13. Acceptable use
You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to access it without authorization, or to place fraudulent orders or payment disputes.
14. Disclaimers and limitation of liability
Except for the express warranty in Section 8, the Site and our products are provided "as is", and we disclaim all other warranties to the extent permitted by law. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential damages. Some states do not allow these limitations, so they may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Ecom Labz LLC and its members, managers and employees from claims arising from your breach of these terms or your misuse of the Site.
16. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. If you have a dispute with us, please contact us first; we will try to resolve it within 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in St. Johns County, Florida, except that either party may bring an individual claim in small claims court. Nothing in these terms limits any non-waivable rights you have under the laws of your state.
17. Changes
We may update these terms from time to time; the version in force when you place an order applies to that order. The "Last updated" date shows the latest revision.
